Acceptance
These Terms of Service (“Terms”) are an agreement between you and [Ask Tone legal entity name] (“Ask Tone”, “we”, “us”), the operator of the Ask Tone service at asktone.ai and the Ask Tone application (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, Acceptable Use Policy, and Refunds Policy, which are part of these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old (or the age of majority where you live) to use the Service. By using it, you confirm that you meet this requirement and that the information you provide is accurate. If you use the Service on behalf of an organisation, you confirm you are authorised to bind that organisation to these Terms.
Your account
You are responsible for your account and for keeping your sign-in credentials secure. You sign in with a password or with Google, and you can add a passkey (WebAuthn) as an extra security key on your account — we recommend doing so. Notify us promptly at security@asktone.ai if you believe your account has been compromised. You are responsible for activity that occurs under your account.
Plans and billing
The Service is offered on paid plans; there is no free tier. By subscribing, you authorise us and our payment processor (Stripe) to charge your payment method on a recurring basis until you cancel.
- Renewal. Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel before renewal.
- Taxes. Prices may be exclusive of tax. Applicable taxes are calculated and added at checkout.
- Price changes. We may change prices, but we will give you reasonable advance notice, and changes take effect at your next renewal.
- Refunds. Our money-back guarantee and the circumstances in which refunds are and are not available are set out in the Refunds Policy.
Credits
Usage of the Service is measured in credits. Plans include a periodic credit allowance, and you may purchase additional credit top-ups. Credits are a unit of access to the Service, not money or stored value; they cannot be exchanged for cash and are non-transferable except as we expressly allow (for example, pooled credits within a team workspace). Plan allowances and top-ups have different expiry and refund rules, which are described in the Refunds Policy.
AI-generated content
The Service works by sending your prompts to third-party AI models and returning their responses. You should understand and accept the following:
- Outputs may be wrong. AI-generated content can be inaccurate, incomplete, out of date, or offensive, and may not reflect our views. Bringing several models together is designed to surface disagreement and broaden perspective — it does not guarantee a correct answer.
- Not professional advice. Outputs are not a substitute for professional advice (legal, medical, financial, or otherwise). Do not rely on them for decisions that require such advice.
- Your responsibility. You are responsible for evaluating outputs and for how you use them.
- Third-party models. The models are operated by third parties under their own terms, as described in our Privacy Policy. Your use of their outputs may be subject to those terms.
Acceptable use
Your use of the Service must comply with our Acceptable Use Policy, which prohibits illegal, harmful, and abusive uses. We may use automated and manual measures to enforce it, and we may refuse, restrict, or remove content or activity that breaches it.
Intellectual property
Our rights
The Service, including the Ask Tone name, logo, software, and design, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify, resell, or reverse engineer the Service except as permitted by law.
Your content
You retain all rights to the prompts and content you submit. You grant us a limited licence to process your content solely to operate and provide the Service to you (including transmitting it to the AI providers needed to generate a response). We do not claim ownership of the outputs you generate, and we do not assert ownership over your prompts.
Third-party services
The Service relies on third parties, including our payment processor and AI providers. Your use of those services through Ask Tone may also be subject to their terms, and we are not responsible for their acts or omissions.
Beta features and API
We may offer beta or experimental features, including programmatic access through an API. These are provided “as is”, may change or be withdrawn at any time, and may be subject to additional terms or usage limits. Beta features may be less reliable than the rest of the Service.
Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that outputs will be accurate or reliable. Nothing in these Terms excludes or limits any rights you have under mandatory consumer protection law.
Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or your breach of these Terms or the Acceptable Use Policy.
Suspension and termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or the Acceptable Use Policy, if required by law, or to protect the Service or other users. Where reasonable and lawful, we will give you notice. On termination, your right to use the Service ends; sections that by their nature should survive (such as those on intellectual property, disclaimers, and liability) will continue to apply.
Changes
We may update these Terms from time to time. We will change the “last updated” date above and, for material changes, provide additional notice. Your continued use of the Service after a change means you accept the updated Terms.
Governing law
